Black Elk Energy Offshore Operations, LLC is committed to safe, reliable and compliant offshore operations. Black Elk Energy is closely reviewing the Incidents of Noncompliance (INC) issued by BSEE concerning the explosion and fire that resulted from the construction project performed by contractor Grand Isle Shipyard, Inc. on the West Delta-32 oil production platform on November 16, 2012. Black Elk Energy does not agree with the basis for the INC and is evaluating its options for response.

Black Elk Energy deeply regrets the loss of lives and the injuries that resulted from this event. "We always have in our thoughts and prayers the victims of this tragic accident last November" said John Hoffman, Black Elk Energy's President and CEO.

In August 2013 ABSG Consulting ("ABSG"), a third party investigator, completed a ninemonth investigation that concluded that on the day of the incident workers hired by GIS or its subcontractor were welding a flange on open piping leading to an oil tank that contained flammable vapors without following Black Elk Energy safe work practices.
